I spoke to the student loan and the refund amount they are taking wont credit my student loan account til 60 days after they receive the refund, anything i can do to dispute this, what if i already made arrangements with the student loan company after the fact
I have outstanding student loans i filed for my taxes and found out that i wont get my return?
Probably not. If you have been in default long enough for your refunds to be attached to pay them, the government has first dibs on the money even if you have made payment arrangements. You can call the collection agent and ask, but the likelihood is that the intent is to get the bad debt paid off as quickly as possible. Sorry.

First off, you need to read the defaulted student loan page at the Department of Education's website: http://www.ed.gov/offices/OSFAP/DCS/inde...
Especially read the part about Default and Repaying.
You have made arrangements with the lender for repayment, so STICK WITH THAT ARRANGEMENT. It sounds like you haven't made enough payments yet to get yourself out of default. Keep making those payments so you can %26quot;rehabilitate%26quot; the loan. There is really nothing you can do now about the tax garnishment, in fact, you should look at it as a %26quot;good thing%26quot; because that is a chunk of the loan you will not have to pay back now. But to avoid this happening again next year, keep making those payments, rehabilitate the loan, then in a few months, seek a consolidation loan (basically, refinance the student loan) and then pay the new loan off on time every month.
Sometimes using your tax refund is a good way to pay off your loan. I knew a girl who owed about $4000 and they started garnishing her tax refund... but she was so low income, the overwhelming majority of her tax refund was Earned Income Credit, i.e., %26quot;free%26quot; money. So only some of her own money was used to pay off the loan. She couldn't qualify for a consolidation loan because her income was so low...but five years of income tax did pay off the loan and now she is done with it.
The only other option you have is what is known as %26quot;injured spouse.%26quot; If you are married, and part of the income tax refund was actually your spouses' income tax refund, that part of it can be returned to your spouse. You will need to contact both the IRS and the Department of Education to find out about this.

If you have already made arrangements with the student loan company they will still get the tax refund and you will just have less to pay back which is always a good thing in the long run.
